Privacy Policy
Date of Last Revision 03/05/2011
Thank you for visiting Kachingle.com (the “Kachingle Site”), owned and operated by Kachingle Inc. (“Kachingle”). Kachingle is committed to treating the personal and corporate information of our users with respect and sensitivity. Our privacy commitment is described in this Privacy Policy.
As our services evolve and we perceive the need or desirability of using information collected in other ways, we may from time to time amend this Privacy Policy. We encourage you to check our Kachingle Site frequently to see the current Privacy Policy and Terms of Use in effect and any changes that may have been made to them. If we make material changes to this Policy we will post the revised Policy and the revised effective date on this Kachingle Site. Please check back here periodically or contact us at the address listed at the end of this Policy.
This Policy is part of our Terms of Use. In this Privacy Policy, we may use terms that are defined in the Terms of Use.
Privacy Philosophy
The Service is a user-centric system and always places the rights and desires of Kachinglers first. While the sites in the Network are the beneficiaries of the Kachingler contributions, because these contributions are voluntary and used to build a Kachingler persona, in product and policy decisions Kachingle will automatically favor the Kachingler over the site. As an example, the Site Owners in the Network are required to reveal all contributions, whereas Kachinglers can selectively reveal their contributions by site.
For all visitors to the Kachingle Site and users of the Service:
1. Children’s Privacy
If you are under the age of 18, please do not use or access the Kachingle Site or Service in any way. We will not knowingly collect or use any personal information from any children under the age of 18. If we become aware that we have collected any personal information from children under 18, we will promptly delete such information from our databases or make it anonymous such that it cannot be identified to an individual person.
2. Information we collect and how we use and share it
A. Log Files: As is true of most websites, Kachingle gathers certain information about visitors to the Kachingle Site automatically and stores that information in log files. This information includes browser type, Internet service provider (ISP) information, referring/exit pages, operating system information, date/time stamps, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the Kachingle Site and services, to track users’ movements around the Kachingle Site and services, and to gather demographic information about our user base in aggregate. We do not link this automatically-collected data to personally identifiable information. We use a third-party tracking service, such as Google Analytics, that may use cookies to track non-personally identifiable information about visitors to the Kachingle Site in the aggregate for marketing research purposes.
B. Personal Information: If you are a Kachingler and/or a Site Owner, please see below for specific information about what we collect from you and how we use it and share it with others.
C. Sharing Your Personal Information: We will never sell your personal information for marketing purposes to someone else. However, we may share it with others as follows:
i. We may provide your personal information to companies that perform services on our behalf, but only as necessary for them to provide those services to you.
ii. If Kachingle goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your information will likely be among the assets transferred. This Privacy Policy will become binding upon the new owner of the information until amended.
iii. We may provide your personal information if we’re required to do so to comply with the law or respond to lawful requests or legal process, or we have a good faith belief that such disclosure is necessary. Examples include:
a. Enforcement of the Terms of Use, b. Responding to claims that any content violates the rights of third parties, c. Responding to your requests for customer service, or d. Protecting the rights, property or personal safety of Kachingle, its users, and the public.
In addition, information about Site Owners may be publicly disclosed as provided below.
3. Links to other Sites
The Kachingle Site contains links to third party sites that are not owned or controlled by us. We are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website that collects personally identifiable information. This Privacy Policy applies only to information collected, retained and accessed by the Kachingle Site, including services available through the Kachingle Site.
4. Security
The security of your personal information is important to us. Kachingle follows generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. While we cannot, therefore, guarantee the absolute security of anything transmitted via the Internet, you may take comfort in knowing that Kachingle uses commercially acceptable means to protect your personal information. If you have any questions about security on our Website, you are always welcome to contact us by email at info@kachingle.com.
5. Consent to transfer and processing
Personal information collected through the Kachingle Site and/or the Service may be stored and processed in the United States or in any other country in which Kachingle or its providers (or their affiliates or providers) maintain facilities. By using the Kachingle Site and/or the Service, you consent to any such transfer and processing of information outside of your country.
6. Unsolicited Ideas
While we appreciate your feedback and other suggestions about the Kachingle Site and Service, we are not responsible for maintaining the confidentiality of any such feedback that you provide us, and you agree that we may use your feedback at our discretion without compensation or liability to you.
7.Updating your Information, Questions
You may view or edit your personal information online by logging into your Kachingle Account and clicking on the Setting link which is at the top of every page of the Site. You may also contact us by visiting the “Help” section on the Kachingle Site, to assist in updating your personal information or if you have any questions regarding this Privacy Policy.
For Kachinglers:
1. Display Name
You always have an option as to how you want your personal information displayed. Your Display Name, which is the public name you choose when registering for the Service, can be anything, including your real name, but subject to the limitations in the Terms (for example, you are not permitted to use a Display Name for impersonating someone else). [Note that you can change this Display Name at any time.] When you start Kachingling a new site, you can choose your default Display Name, a special Display Name for that site only, or “anonymous”, in that Site’s Medallion or on the “Settings” page. To change your displayed name on just certain sites that you have previously kachingled, go to “Sites I Visit” on the Kachingle Site and modify each individually (subject to conditions in Terms of Service).
2. email adress
We will use your email address for occasional correspondence to you, though it will not be shared with or sold to other companies, and will not be used for external marketing.
3. Pay in information
In setting up your Kachingle account, you authorize us to take a recurring monthly amount of money from you, as specified by you during the signup process. When you provide a payment source to us, you authorize us to collect and store it securely, along with other related transaction information.
4. Recording your use of the service
Once you become a Kachingler, you can turn on kachingling on Kachingle-enabled sites (sites that are part of the Kachingle system) using the Kachingle medallion (the kachingle object which opens up to a menu when you mouse over it). For sites that have kachingling turned on, we collect information about your activity on those sites via web browser cookies. We do this so you can avoid having to re-identify yourself manually each time you visit the sites you have chosen to support. We use this information to count the number of times you visit each site and then to divide up your monthly contribution based on the number of times you visited each of your chosen sites during the month. We encode our cookies so that only we can interpret the information stored in them. You can decline our cookie if your browser permits, but doing so will interfere with the use of our service.
No information is collected about your visits to sites displaying Kachingle Medallions unless you have "turned on" the Medallion to indicate you want Kachingle to count your visits to a given site. When you have turned on a Medallion, Kachingle captures and stores the total number of daily visits you make to that site, and this information is displayed on your public user page on kachingle.com (example). If you choose to Kachingle a site anonymously, this information is collected but not displayed publicly. We do not share our user data with anyone in any other way except on the above-described user page on Kachingle.com.
5.IP-Adress:
We do not collect your IP (Internet Protocol) address.
For Site Owners:
1. Medallion activity is publicly available
Please be aware that most information we collect through the Service related to a Site Owner and their Medallions is available to the public on the Service. Except for the financial account information associated with each of your Medallions and your Kachingle Account login information (user name and password), all other information about activity through the Service involving your Medallion(s) is publicly displayed to everyone with access to the internet, whether or not they are a registered Kachingle User. This includes all monies received by each of your Medallions, and from whom these monies (including amounts) are received (subject only to privacy constraints imposed by the Kachinglers). We only use this information for display and accounting purposes, and this information will not be used for any other purpose.
2. Medallion activity remains publicly available even after suspension
Even after a Medallion is removed from your site and marked as “inactive” on the Kachingle site, the history of that Medallion may remain in the Kachingle system on an ongoing basis at Kachingle’s discretion. This includes information about your site, traffic to your site, payments to your site accrued prior to its removal from your site, and other information relating to your site in connection with the Service, as part of the Service, including for use for historical financial tracking purposes, as well as for publicly displaying the contribution history of Kachinglers and the Pay-Out history of Site Owners.
